He declared a bogus "national emergency" and stopped accepting asylum applications . But immigration law requires their acceptance and processing if the applicant is present in the US.https://www.rescue.org/article/it-legal-cross-us-border-seek-asylum

the emergency was biden opening the border to everyone...no vetting. the phone app was not legal.
