By sweating and earning it? By labor of love? By the act of taking it from nature by will of mind? By sheer stubbornness? By being smarter than our natureal environment?

yes. by all of these. and more.

A thinking... living... being can "own" anything except his or her equal. That is the law of the universe. Oh! Happy day! We are the rulers of all we see and care to conquor! Including ignorance! Long live reason!

Let us imagine your great-great grandfather settled in Hawaii. The native tribes own all the land and he and other settlers arrange to buy some land. You pay a fair price and assume the foreshore - ie up to high water mark and the sea belongs to everyone.

Now native tribes say they own the beach - they never sold it. You need permission to go there or to swim in the ocean.

Your reaction?

You can't buy land. End of story.
I know the law says you can. But you can't. It only takes one person to say: "Bollocks." And that's it. He starts a war. Takes it from you. And you can wave all the little slips of paper you want, you won't be getting it back.

So when the settlers arrived, they should have declared no-one owns this land? And commenced to cut down trees, build houses and fences?

Does land belong to the people with the most guns?

That's almost precisely what people did here in Australia as far as I am aware. The b*stards.
