@DJJ saidThe 14th Amendment does not specify convicted or even charged.
The 14th Amendment Does Not Disqualify Felons From Holding Office
It does bar public officials who had sworn an oath and then ‘engaged in insurrection or rebellion.’ Neither of which Trump has convictions for.
The text of Section 3 is as follows:
"No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability."
No 'conviction' or even 'charge' necessary. We all saw him engaged in, and inciting his followers to engage in, insurrection.
@DJJ saidTrump has been charged in a 36-page revised indictment with four different violations of federal criminal law in his attempt to overturn the results of a United States election.
@Suzianne
Why is he not charged then?
conspiracy to defraud the United States
conspiracy to obstruct an official proceeding
obstruction of and attempt to obstruct an official proceeding
conspiracy against rights
"Engaging in an act of rebellion" is different from speaking your mind, or filing a court case, or burning a flag in protest. He was free to do any of those things.
But leading a conspiracy to overturn the election is not any of those things. And no one disagrees that he did "engage" in those acts - he had admitted to all of it.
TRUMP admits that he engaged in rebellion.
So Trump is disqualified from seeking federal office. It's not hard, really.

@spruce112358 saidSpruce is getting a bit off, must be worried his govt handouts are about to dry up… Maybe he promised his wife a new house that the government was gonna help him pay for. That would be a downer, I must admit… About the wife I mean.

How did you know that I promised the wife that we could move into Mar-a-Lago "soon"? And Trump was going to pay for it?
😆
But AvJoe... I have to tell you. It wasn't my wife.
It was YOUR WIFE!!!
So you see, you caught me. I don't know how, but... well played!
@AverageJoe1
And this has something to do with the deepening legal difficulties of Trump HOW? Now you would not be trying distraction would you? Nah, you are MUCH too honest to do that, right?

@sonhouse saidI don't ever think about legal difficulties. You do. All about the past with you, which is a trait of negative people. I, and Trump, think about the future. Positive people. Your Kamalaaa preaches hate and devisiveness, the Hitler thing, poor vs rich, socialism, the works. A creepy person.
