As well as justice being done it needs to be seen to be done.
Using the civil law system as a model: I suspect the the police/ security services will often use methods that can't be used in court, but use such methods to positively identify culprits and direct the collection of evidence that can.
I'm coming to the conclusion, after following the exy debate, that if the decisive evidence can't be published then it shouldn't be use in the banning decision.
