It's interesting to note who the dissenting justices were in this decision. O'Connor, Rehnquist, and Thomas. The first two lines of Thomas' opinion:

Respondents Diane Monson and Angel Raich use marijuana that has never been bought or sold, that has never crossed state lines, and that has had no demonstrable effect on the national market for marijuana. If Congress can regulate this under the Commerce Clause, then it can regulate virtually anything--and the Federal Government is no longer one of limited and enumerated powers.

For the whole thing you can go to:

At the risk of being either considered "dense" or Bowman-like....what's "tolarized?"

That means it's illegal, but you're allowed to do it.
The two main reasons they keep it illegal are:

- European law (too much hassle)
- Whilst it's still illegal, they can raid whatever they want without too much hassle as well. Once it's legal they need more court orders and such.

I do think coffee shops (marijuana bars) have to pay taxes though. Basically the same construction prostitutes had whilst they were illegal (they are legalised now though).
