Click it. Them's the rules. His/her fault for not paying attention to his/her games. Having a life outside of chess might be okay for OTB, but CC requires constant attention.

If you think you have a clear winning position than just click it. Just assume your opponent is too shy to resign or he or she taking chance that you might be banned from this site. Otherwise you have to wait as long as you can effort to wait. It is ok to click the skull if you don't feel bad about it. Since you ask our opinion, I think you are not that type of person.
I clicked once. For that game I knew for sure that I should have won somehow.

He's been waiting for his opponents to make their first moves since April. It would be a crying shame to click the skull on this man. Men of his caliber don't come along everyday. He would never think of obtaining a cheap victory by clicking a skull. No sir, to him such a victory would be a disgrace to the game itself. As would clicking a trash can icon in order to delete a game. He has started these games and by god he is going to see them through to the bitter end. We could all learn something from this guy.

Though this one does have an interesting under current.
So you don't move from May to Ocotber and your opponent
does not take your skull.
Then after 4 days without a move from him his skull appears.....
A dilemma.
PM him saying;
Hi
I can click the skull that has appeared and win the game on time,
but as you never clicked the skull to claim the win when I failed to move
on time I shall refrain as it seems the sporting thing to do.
However in future and in the spirit of the game if the skull appears
again I'm afraid I will not hesitate to claim the game.
If I don't then we could both end up in limbo with one of our game slots
filled up forever.

I had not thought out the significance of nonsubscribers - only 6 game slots - otherwise how on earth could you time out a guy who has waited patiently 5 months? Credit to Kaminsky "nothing for it but to wait". But Greenpawn surprises me again. Good answer.
