The article I read said, that the mother attempted to give the child to the father until she got things legally worked out to come back when legal. The article stated that authorities would not let the child go with the legal father until then. I will look into it further and get back to you.
I also question your use of the word criminal. What I read was that her visa expired and she did not renew it in time; hardly a criminal act. Deportable act, yes; Criminal act, hardly.
