That's EXACTLY my point. Because with all these analyses and estimates being presented, there are still many unanswered questions:
1) Where is the table of baseline characteristics for the demographic groups?
2) Which sentence for each individual is being analyzed? First? Longest? Last? Because if the same individual is in the database multiple times, that reflects non-independence and has to be adjusted for. Recidivism has to have a huge effect on sentencing, but I don't see where they are adjusting for it.
3) And the point you raise, where is the adjustment for 'mitigating circumstances'? How do we know that two armed robberies were 'the same' so that we would expect identical sentences, all other things being equal? Hence my interest in Appendix C which are the Offense-Specific Analyses.
However, I will state my overall point once more just for clarity: a simple breakdown of the numbers in a 2x2 table is not going to answer the questions we would like to ask. THAT's my main point. 😆

In the US we have the presumption of innocence. Someone is presumed to be innocent of ANY crimes until they have been found guilty in a court of law. So why would police officers decide to execute: a) someone who was producing a driver's license as requested, b) a 12 year old playing in a park, c) someone standing in their own apartment, d) someone sleeping in their own apartment. Why did the police officers decide to abandon the presumption of innocence in these cases?
The usual explanation is that the officers were scared or felt threatened, but being scared of black people who pose no threat IS racism. Fear is the root of racism - fear of people who do not look like you.
So is it a huge number of officers who are racist and are they killing a huge number of people? No, probably not.
What we have is likely a few "bad apple" policemen who are racist, scared of black people, and so more likely to violate the Constitutional rights which all Americans, regardless of color, enjoy.
Getting such people out of the police force is probably a good idea since they cannot perform the duties required of a policeman.
