3) I have no idea whether there's a case for tax evasion or not. Where they are based on dubious accounting tricks (which seems to be the case here), they are almost always settled with payment of back taxes, penalties and interest rather than a criminal case.
The Mueller Report laid out a strong case for Obstruction of Justice but Merrick Garland's DOJ has declined to proceed with it. One can speculate why.
