Arrest him for not signing a ticket???? What a jerk. In Utah, the officer normally merely makes a notation on the ticket that the motorist refused to sign and that's only after the cop has explained to the motorist that signing is not an admission of guilt. This cop never did that and was obviously on a power trip.

It's a lot more complicated than that. In most jurisdictions if you don't sign the ticket, you go to jail. Any idiot who thinks he's going to tell a police officer what time it is deserves to go to jail.

The police officer has the legal authority to arrest for not signing the ticket, but generally they don't. And an explanation is always given.

Contrary to the fascists here, questioning why you got a ticket, even if you are somewhat agitated about it, isn't cause for throwing someone in jail. I've read a few articles about this case and the cop was in a speed trap right after a sign changed the speed limit from 65 MPH to 40 MPH. The driver here was asking the legitimate question where the 40 MPH sign was and the cop refused to answer him. Even at that, the driver still didn't do anything threatening. The use of a taser against him was unreasonable and that's why the State wound up paying. They would have been well-advised to fire the trooper as well as he seems to be a hot head.

The cop didn't "deceive" the guy from what I remember. I remember a clear command - "get out of the vehicle". Anything else the driver thought was purely from his own imagination.

When the driver turned around to walk back to his car, he started to reach into his pocket, that's when the officer zapped him, and rightfully so. Safety first !

Even if the cop tasered him just for running his whiney stupid mouth, it would still be justified. What should the cop have done if not use the taser? Get in a wrestling match on the side of the highway? Risk both of them falling into traffic? Dipsh#t clearly wasn't going to cooperate. It doesn't matter whether most cops arrest for not signing the ticket or not. If that guy had cooperated everything would have been fine.

Exactly. From the minute he opened his mouth, he made it clear he was not going to do anything the officer asked him to do and tried take control. He did it with the most annoying whine I've ever heard from a grown man, like he was used to having his way. Then he turned around and started to walk off. What was the officer supposed to do, just stand there, helpless, as the guy got back in his van and drove off?

A policeman's salary is paid for by MY tax money; ergo, I OWN his arse. Not to mention, he's a public SERVANT, and most definitely fair game for being "told what time it is", especially when he is wrong. These gun-totin' servants NUST act with more restraint than the average person; it's their f---ing job. I'd have held out for 400 K.

His wife also seemed pretty stupid. If she had any sense, she would have told him to quit arguing and sign the ticket. It's written on the bottom of the thing that signing is not an admission of guilt. Argue about it in court. The cop was following the law and when stupid moron turned his back on the cop and put his hand in his pocket he left the officer no choice.

Judging from his behaviour, I'd bet his wife was too afraid to try to talk sense to him, she'd probably catch hell from him later for presuming to correct him. He's obviously a spoiled, over priviledged bully.
