There are no laws about the flags. There are customs and etiquette, but they are unenforceable by law.

In the US, you have a constitutional right to burn the flag in public if you so choose.

It is perhaps worth noting that a proposed Constitutional amendment to limit free speech and make flag desecration illegal was only barely defeated in the Senate.

First of all, defeated they were. Almost doesn't mean squat. Texas v. Johnson itself was a 5-4 decision, but it's held up as the law of the land for over 25 years.

Second of all, a constitutional amendments require ratification by 38 states... no easy task. The ERA was passed by the House and Senate and died in state legislatures.

Section 1 is about commercial usage, which is a different issue.

Section 2 is unconstitutional.

Neither section involved the flag of the United States.
