Biden is trying to control the border with inadequate resources because Congress won't approve his requests for more that he has made consistently since he was inaugurated. Now right wingers want him to make executive orders that violate existing law (while calling him a "dictator" whenever he makes an executive order in other circumstances). This is all political hackery of the highest order raised to the degree of open rebellion by the Governor of Texas and a bunch of other Republican Governors who now claim the authority to disregard legally binding orders from the highest court in the land.

Here's the reported deal:

Mandatory detention of all single adults.

- Mandatory “shut down” of border once average daily migrant encounters hits 5,000. Importantly, this 5,000 number includes 1,400 CBP One app entries at ports of entry per day, and roughly 3,600 illegal crossings per day.

- How is that enforced? Once the 5,000 threshold is hit, a new authority is codified into law that requires Border Patrol to immediately remove illegal immigrants they catch without processing. They would not get to request asylum, they would immediately be removed. This includes removals back to Mexico, and deportations to home countries. This would be a *massive* change from current policy, which is that once an illegal immigrant reaches US soil, they must be processed via Title 8 and allowed to claim asylum. Under this new authority – they are not processed, and they are mandatorily immediately removed once the “shut down” threshold is reached.

- This “shut down” also takes effect is there are 8,500 migrant encounters in a single day.

- The “shut down” would not lift the next day. It wouldn’t lift until daily encounters are reduced to under 75% of the 5,000 threshold for at least two weeks. This means the “shut down” authority would not lift until two weeks of an average of less than 3,750 migrant encounters per day.

- Some family units will be released with ATD (Alternatives to Detention, ankle monitors etc).

- New removal authority to immediately remove all migrants who do not have valid asylum claims, which will be determined within 6 months rather than the years long process we have right now.

- Any migrant caught trying to cross twice during “shut down” phase would be banned from entering US for one year.

- US will need agreement with Mexico for MX to take back non Mexican illegal immigrants. This hasn't been ironed out yet.

I think it's odious and shortsighted. Biden is caving to extremist demands due to political expediency; Senate Conservatives like Lankford of Oklahoma admit that a Republican President could never get this to pass in the Senate.

Thankfully, the right wing crazies in the House, in thrall to Donald Trump, will kill this. Biden can go back to dealing with Texas' rebellion against the authority of the US government if he has the will to.

There is nothing political about it. First, Biden has nothing to do with it, a puppet. It is all being run by people llike you who want to bring our country down and create socialism. Sorry, I don't write well about such matters, makes me sick. Roark vs Marx, don't you know?
With all that you just wrote, could you tell us why he (handlers) all of a sudden pick present day to make some huge change at the border? What a mess. And you are loving it. Hey, how can so many governors, that know a lot more than you do, come together to stand behind Abbot.? Are they not aware of what YOU think , their thoughts be damned??

I guess I could dream up one sentence....Follow the law exactly as it is written, and send home all of these people that you can, as they are illegally in this country.

Your highlighting 'LEGAL' is funny. Why would it be anything else? Joe himself is illegal in many ways, was it legal for him to let a citizen use his (our) plane to make millions of dollars. HOw do you live with so many schisms crashing together in your thoughts.

Title 42 can only be used during a national health emergency (Public Health Act of 1944). None exists now.

Has I have explained to you over and over and over again "the the law exactly as it is written" allows persons who cross the border to apply for asylum and have a hearing even if they do not cross at the designated points of entry. Those who do so are not here "illegally".

Those Governors are supporting open defiance of a legally binding order issued by the US Supreme Court. There is absolutely no constitutional justification for that and no, they are not some wise, impartial group but a bunch of politicians pandering to the MAGA base. The doctrine they are supporting was supposed to be put to rest in 1865, but Southern Governors tried the same BS in the 1950s to resist the dismantling of segregation. Those Governors were on the wrong side of history and the Constitution just like these ones are.

Generally, a citizen of a foreign country who wishes to enter the United States must first obtain a visa, either a nonimmigrant visa for a temporary stay, or an immigrant visa for permanent residence.

Marauder. Theoretically, of course, as you cannot leave your nexis, would you feel comfortable carrying a sign down the street which says something to the effect that we should let people who are citizens of other countries walk across our border and take up a life in the USA?

Note how simple, how personal, my question is. I don't use words like court, politicians, MAGA, 1865, history, doctrine, etc. Isn't it refreshing? If your partner asks you this morning...Do you think we should allow these millions to come here, costing us billions and disrupting everhthing they touch, like schools, our homeless society and everything else......would you answer with such a paragraph, or maybe say instead, Gee, I don't see a problem with letting them in.??

You make things "simple" by lying about other people's positions. By now, you and everyone else here knows I don't support an "open border" but you can't help claiming it because dealing with my actual position seems an impossible lift for you.

I'll state it one more time:

In times like this in a country with an aging population and a shortage of workers, Immigration should be encouraged.

While there should be a vetting of immigrants, the presumption should be in favor of their admission unless there is a good reason to deny it.

Immigration is a substantial economic plus and almost always has been for the United States and foolish xenophobia is detrimental to the nation's well-being.

The present disorder at the border could be largely remedied by Biden's proposal to add more Border Patrol agents and Immigration judges, something that Congress has refused to do for years.

Why don't you try responding to those positions rather than pretending other people want "open borders" or ranting about their non-existent "communism"?
