The DoJ first gathers evidence which has a likelihood of standing up under judicial scrutiny, and that has little to do with when an alleged crime may have been committed, and nothing to do with whether it occurred before or after some other alleged crime.

Trump had to "reimburse" money he took and used for his own personal gain, in addition to damages he paid to eight different charities for stealing money. The money was only donated to charity *after* Trump was caught.
Most people would go to prison for what Trump did. Two-tiered justice system indeed.

In fact that's part of the system which will never be perfectly arranged in neat lines. The more you crack down on crime the more innocent go to prison. The more lenient you are the more criminals are not punished. The punishment is based on what evidence there is.
