"A person is guilty of falsifying business records in the first degree when he commits the crime of falsifying business records in the second degree, and when his intent to defraud includes an intent to commit another crime or to aid or conceal the commission thereof.
Falsifying business records in the first degree is a class E felony."
Now if there was a strict constructionist judge interpreting that statute, would he say a Federal crime doesn't count as "another crime"? Not to say that there aren't other predicate crimes available under the facts, but to me the clear wording of the statute suggests the answer would be "no".
