Marauder continues to get caught up in random side issues, even his 'the law' is a side issue, I just hate it for him.
He will not recognize the crisis at the border. Texas recognizes and eats it everyday for breakfast. Were Marauder a free-thinker, which he is most absolutely not, he would see the crisis and comment on the crisis. I do not know what he is writing about.
The diff in him and me is that he spends a lot of time (evidenced by his tremendous research, worthy of a prize at a college of a researchers) memorizing all this stuff. I do not, so he got me on that one. I am presently spending wonderful time at a plaace called Les Houches and hardly have time to research. So all I think that most of us should be expected to do on a forum such as this is to render personal opinions, about such issues as invasions, the taking of money from one person and giving it to another, making your child swim in a swim meet with a grown man, that sort of thing. And with all. due respects Shouse and Marauder and these others with their tomes and reciting all the law, I am not interested in doing it. Would you all not prefer logic, common sense and rationale? After all, the law that he keeps boring us with arose out of common sense, logic and rationale, did it not?

I'll explain this one more time:

The Border Patrol has statutory authority to. you know, patrol the border.

In this case, Texas put up razor wire blocking them from having access to the border. The Border Patrol cut it so they could do so. Texas responded by suing the US government in Federal Court to prevent the Border Patrol from doing so (hence Abbott's claim that BP is "destroying" Texas' property).

The lower court dismissed the suit, but Texas appealed and the 5 Circuit, an intermediate appellate court, agreed to hear the suit. That court also issued an injunction barring the BP from cutting any more of the razor wire while the case was pending.

The US Government filed an emergency petition to the SCOTUS, asking that the injunction be vacated. The SCOTUS granted that relief.

So since the only thing legally preventing the BP from removing the razor wire to access the border was the injunction and the injunction is now vacated, BP can legally remove however much of the wire it pleases. Texas is physically preventing them from doing so, so it is in violation of the law. Simple.

True, the SCOTUS isn't preventing Texas from putting up more razor wire to replace that which BP removes, but so what? Texas is now legally barred from preventing the BP from removing the wire to access the border, but it is doing so anyway.

That's where the "rebellion against the authority of the United States government" part comes in.

No Texas is not preventing BP from cutting the wire. BP is barred from the park, it is Texas property. BP can access the wire from the water.

BP wants to use the park as a staging area, SCOTUS did not give BP that.

Your assertion is ridiculous; it would give any State an unlimited power over where Border Patrol can operate. But BP's authority over the border is codified in Federal law and that overrides State authority in this area (check the Supremacy Clause I already posted).
