And this is where you libs screw up all the time and the reason why you think the constitution can be,, aHem,, sidestepped.
The constitution establishes individual rights for all citizens, not societal rights.
The Constitution established no rights for anybody nor did its Framers believe that was possible or necessary (they believed in Natural Rights not man made ones).
What it did was "constitute" a government for the United States (hence the name).
The Constitution does specifically declare that it is meant to, among other things, "promote the General Welfare":
