Let's hope it turns out they can't. I would think that there is a pretty solid case here for vegetable farmers all over Europe to sue the German government for damage compensation (which will run into many, many millions), and for the Spanish ones to sue for slander as well. Both Berlin and Hamburg put their foot in it big time.
