A while ago at work(I work in a factory, in the manufacturing area) I lost my temper with a young man that had been harrassing me for quite some time with intimidating behaviour.I went up to him and told him (in no uncertan manner) I had had enough of his s@!t and I was going to report him.This young man,23ish, happens to be the site union reps son.( strong union on site. Australia).
For obvious reasons I went to tell managment to tell him to back off,and as I was doing this he approached the union.
I told management of many incidents of concern about him and the upshot of it all was I got a formal coucelling discussion that I was to sign to go on my record.you see, he made a FORMAL complaint that I swore.
there is much much more to this as I kicked up such a fuss that they eventually got a soliciter in (after trying for two months to get me to drop it all) to investigate and he was found to have committed 5-7 breaches of policy, some serious.I rejoiced when I received a summary of the findings but this young man is still working there and I do not know what (if anything) they did about it.
I am demanding the councelling be withdrawn and an apology given from management.
This is a normal factory where swearing is the norm(even by the bosses) .There would not be one person in the place that has heard me use coarse language. In a real temper I said sh!t.
I know I am not being entirly rational but I am EXTREMELY upset at the company hitting me for a non-event while desperatly trying to get me to not persue my claims that have since been substantiated legally. I am now being threatened by the company (with notice that I will recieve a written warning) that I may not even tell anyone anything about the report.not even that I have been vindicated.
I have been with the company 25 yrs with not 1 councelling. not 1 problem of this nature. and one of the better sick records.
I have a lot of support from my co-workers, many of whom have complained about him. though not FORMALLY, for various reasons.
Does anyone have any opinion (prererably with experiance in these matters ) about what I can do about this.

Sorry to read about your predicament. You have every right to have your feelings heard; if management refuse to listen; and more importantly threaten you about discussing the issue , l would suggest you contact the Equal Oppurtunity Commision in whichever state you are in (Victoria here) and they can see if there are any grounds for the issue to be carried further (my sister is a lawyer with them)
Once your bosses are advised that you have made contact they will pull there heads in very quickly!

Does it state in your terms of service (company handbook etc) that you cannot discuss this problem with an outside body?? Also the form that they asked you to sign, did you sign it??
Is the management team at your place the highest you can go?? Are there likely to be any repercussions from this young man??

One thing I really need to know at this stage is can they give me a warning (councelling) for this language.The young man involved uses coarse language often so is unlikely to have been offended by that. Also I was asked to apologise even though the councelling would still stand.They brought a professionial mediater in to get me to drop the matter.Twice.Really pathetic.
I seem to have got a double dose for nothing and he gets what? for double.No much more though I am scared (Yes scared) to say what he was found to have done. disclaimer -- or not.

Go everywhere, the union heirachy (if a member), solicitors, anti discrimination board, and lodge a formal complaint against this piece of crap.
Stick it to your workplace to for failing to ensure a safe workplace. Obviously 25 years of service counts for not much in the face of union nepotism.

I would consider going to the union guy who is superior to the father of the villain. They shouldn't allow this sort of thing.

Get copies of all company handbooks/policies/copies of all literature from the case and go and see a solicitor. Find out exactly where you stand.

- That is their job, that's why they get paid. You sound like you have a genuine founded case.

If not, you should follow the chain of command; i.e. FIRST go to your own supervisor, then if you get no joy from him/her, their direct boss, etc.
Also, at the same time you can go to some kind of citizens' Advice Centrer (if they have them in AUS).
Then go plss in his fuel tank.
