Yes but OTB (after you have been playing for 4 months) your opponent does not take his annual vacation either.I agree there is a difference between time outs OTB and here on RHP and some people can exploit the difference to their advantage as you descibe. But I can't think of a simple rule to prevent this.
Should I lose on a timeout when I go on vacation when my opponent can only be bothered to move every 7 days and I move within 1 hour of him therefore we have only made 16 moves (he has taken 3 months 21 days thinking time and I have had less than 7 days) but now I have 14 days leave ...[text shortened]... g slowly not me.
Perhaps it was always a ploy as he knew sooner or later I would go on leave.

In OTB, in a tournament, when the flag drops, as you say, the game is over and no one disputes this. When a skull appears on RHP you can chose to allow your opponent more time if you wish. Nothing wrong with treating the skull as the end of the game, but people can and do exercise a personal preference in this area.

Fischer refused to play the 2nd game.Would be kinda silly to whine about a loss when it's you who refuses to play,don't you think?

Don't know if it was ever brought up in site ideas, but instead of putting up the vacation flag all players could be allocated, say 30 days of holiday every year. That would allow players to postpone all their current games at any time.
I know it would be more difficult to plan tournaments such as the annual Championship, but it would protect players from being timed out if they are on REAL vacation.

After 6 months (26 weeks) you are on move 26. Your opponent has used all his time every move so he used 26 weeks, while you used 26 hours.
You set your vacation flag and leave a note on exactly when you will be back. You get back 14 days and 2 hours later. Surprise, surprise! This time your opponent did not wait 7 days to reply but replies instantly and 1 second after the skull appears claimed a time out in a totally lost position.
Is it just me or is this fair? In my opinion it is a clear abuse even if not against the TOS!
