The sanction of capital punishment was pre-law, as are some other things.
"The Law" was given to a specific people of whom God, as of the birth of the church, has temporarily set aside.
During the period from the inception of Israel until the birth of Christ the law required death for adultery and murder for which there was no provisions in the law for forgiveness.
And this is where it gets complicated....
