I could make a thread out of this one question. Given all of the discussions about surgical procedures regarding these people, changing their bodies around, all claiming to have different designations and categories regarding their gender and sex, and Tran, whatever that means… Does a man who has had his genital area totally wiped out by a car wreck Have his sex changed, or is he still a man.?
This, of course, has to have a simple answer, and I for the life of me cannot decide what it will be… Except that he is still a man. If we can’t get an answer in this thread, I guess I will open it up in a new thread. I may have to mention names. One has to quote sources on the forum.

Mostly in our society, we go by self-reporting. When you go to the DMV to get a license or ID, you check a box M or F (I'll have a hypothetical on this later that I insist you answer). So if someone who identifies as a man loses his genitals due to a catastrophic accident but still identifies as male, I'd say he was a male (note by your prior proposed definition which relied on reproductive ability this person wouldn't be male or female). But suppose this person said "Well, I never liked having those genitals anyway; I'm going to get a vaginoplasty and identify as a woman". I'd say he was now a woman the other right wingers say he's a man with a vagina. How about you?

Okay, A DMV hypothetical: you and your wife go to the DMV to renew your licenses. You fill out the forms marking your sex as "M" and your wife's as "F". The clerk takes then and says:

Clerk: Okay, you and your wife will have to disrobe so we can check and make sure of your sex.

YOU: No way!

Clerk: Sorry, it's required by a Presidential Executive Order that if you drive on any interstate roads or roads that connect to them, we have to verify your sex by visual inspection by 20 clerks or the Federal government can take away our highway funding.

Would you say that was within the President's powers? Why or why not?

Hypothetical two:

You're at the hospital and your daughter is giving birth. The baby emerges and after a quick visual inspection the doctor declares "It's a girl!" Everybody is happy at this joyous occasion.

Two days later, you're sitting in your daughter's hospital room with her and little Joeanne, and the same doctor comes in. He says:

Doctor (embarrassed): I'm sorry there's been a mistake. We did a chromosome test on Joeanne and he has XY and is therefore a man by virtue of the President's Executive Order which relies on their "biological sex" at birth..

Joe (outraged): What are you talking about? Look at her "junk" she's got a vagina, ovaries and a uterus!

Doctor: Sorry, the President says that doesn't matter.

The sum of your post is, as usual, that a man wakes up every day and decides which he would be, man or woman on that day. So he be's a man, and notices that DMV today is giving away a coupon for 20 gallons of free gas to women.
He goes to DMV, (may put on a wig to make it easier, though that is not one of your required elements) and walks up to the coupon office and tells them he is a woman and wants a coupon.
That defrauding of the government is also defrauding the citizens, whose taxes paid for the coupon handout.
I could ramble, like the next day he gets a handout for men only, but let's keep it simple.

That is an easy one. My opinion? There is no way to say unequivocally that the baby is a male or female. An unfortunate human being. She/he lives his/her life how she wants to and , hey, he/she is not IN YOUR FACE everyday telling people all about it. Maybe a parade!!!
