Homosexuality can be called a mental disorder, rules Chinese court

Homosexuality may be considered “a psychological disorder” in the eyes of Chinese law.

Citing controversial academic literature, a court in the eastern Chinese province of Jiangsu ruled that a textbook defining queerness as a disorder is not “factual error,” but a divergent “academic view,” the South China Morning Post reported. The ruling, from the Suqian Intermediate People’s Court, upholds a lower court’s ruling.

Is it reasonable to say that China "started from a very conservative base"? As I understand, homosexuality was relatively widely accepted in pre-modern China, until legal sanctions were imposed under the Qing dynasty. I've read that there were also a number of pre-modern works of Chinese literature focusing on same-sex love. Could it not therefore be said that China started from a rather liberal base, before moving temporarily in a more conservative direction?

If I'm correct in this understanding, it would somewhat parallel the situation in Japan, where homosexuality was openly practised (and frequently described in literature) in the Edo Period (1603-1868), before becoming stigmatised (and briefly made illegal) in the late nineteenth century (during a period of Westernisation).

It's slightly more complex than that, however. In the first place, the Japanese jurists who decided to criminalise "keikan" / sodomy in 1872 may in part have been inspired by Western models; but they also, according to Bernard Faure, drew on the legal codes enforced in Qing China! (This doesn't of course undermine the general point you make, in so far as those Qing prohibitions may themselves have been inspired by Western influences in China).

Homosexuality was decriminalised in Japan after only eight years, in 1880. This also seems to have been inspired by a Western intervention. French jurist Gustave-Émile Boissonade was invited to Japan in order to help modernise the legal code. He (as one might expect given his background) proposed the adoption of a legal code based on Napoleonic Code, which had decriminalised such "imaginary" crimes of sodomy.

As for the main concern of this thread, I don't believe modern China is the easiest place in the world to be gay. But it is far from the hardest.
