But to your point, if that guy beat the hell out of someone on the street, or kills somebody, or steals a silver candlestick at the church, that is a crime that must be prosecuted.
You see, we don’t prosecute aliens for the crime of invading the country, their only punishment at that point is to be sent home. You see the difference.

What if that person holds certain political beliefs?
You can’t judge. And the authority charged with arresting isn’t certified to judge (can’t even be, due to the seperation of powers).

Right now the only thing we can do to solve the problem is try to figure out who they are, which is very difficult, and send them the hell back over the river. Would we hire a language expert to listen to their accents to decide what country they should be from? I don’t know.
