I suppose they would need a judge to approve listening to it, but I'm sure the NSA listens without any approval that is needed to avoid violating the 4th constitutional amendment. They do what they want. Not sure why Obama is even needed for that to happen though. Maybe he just needs to blame a specific person so he picked Obama.
Is a presidential order needed at all? If it is, that would explain the blame being put where it has been.
