Just because right wingers like yourself rejoice every time a black man is killed doesn't make it justified under the law.

The case was rightfully prosecuted and it is up to the jury to decide.

I see the racial implications worked with you, as it will with all lefties…the whole reason for the prosecution

People who rely on articles or talking heads in the media for their facts get nowhere near enough information compared to a jury at a trial to criticize the latter.

The case is about excessive force, not about whether anyone should be "helped" or not. The law sets limits on the use of force.
Of course, and nice to see a poster recognize an issue at hand, but I have simply said, no matter what the outcome, that even if I were a boxer and karate expert,.there is no way that I would step to the aid of someone where I would be subject to being in any way found guilty of anything. Guess I would be a bystander, perhaps be careful to not lose my ipods.
The 'law' has made a big mistake. And further this clueless inadeqate judge has stepped out of his purview, I know that and am not even a trial lawyer. He will be in trouble on this one.

No, it hasn't.

They said they were deadlocked on the manslaughter charge, but the criminally negligent homicide charge is still before the jury.

Few right wingers would be crying about this trial IF Penny had killed a white man; trials involving whether excessive force was used are commonplace in the US.

Penny's extremely fortunate the jury couldn't agree on the manslaughter charge; he held Neely in a chokehold for almost 6 minutes and refused to let go even though another passenger told him so because Neely wasn't moving.
I read this as your making a prosecutor's argument.

Penny restrained him and then the other three jumped in to help keep him subdued.

Like choking someone to death?

The Medical Examiner said Neeley was choked to death and video showed that Penny held the chokehold for almost 6 minutes, including after Neeley was no longer resisting.

That's ample evidence to charge and a DA would have been derelict not to do so.
