I'll let the jury decide but according to testimony of one of the guys who helped him hold Neely down, Penny was told to relax the grip but refused. And neither of the charges require intent to kill nor did the prosecutor argue that Penny had such intent. The issue is whether holding him in a chokehold for 6 minutes causing his death (though I guess that is an issue, too though it would be remarkable that a 30 year old male would coincidentally die of different causes at the same time a chokehold was applied) was "reckless" or "negligent".
