@Cliff-Mashburn saidYou have a very low threshold of "heroism" when a white man is using force against a black man, don't you?
Penny restrained him and then the other three jumped in to help keep him subdued.
And the guy STILL was fighting and trying to escape..
@no1marauder saidhere we go folks…it was racism all along, only its against the white dude

@Mott-The-Hoople saidDidn't claim Penny's actions were motivated by racism.

But it's a good bet your and Cliff's reactions to the incident are.
@no1marauder saidThe prosecutor in this case is the same one that reduced the murder charges of a black man who came up behind an elderly man at an ATM and killed him for 30 dollars, reducing the charge to manslaughter and requesting a minimum sentence in what she called "restorative justice".
I keep forgetting that right wingers are so deluded they think the US justice system is biased in favor of persons of color.
If anything, it's the other way around. Blacks are being let out with dozens of violent crimes against whites with no bail required, while whites are being arrested for defending themselves against blacks.
@no1marauder saidsure you are

@no1marauder saidI don't think citing cases where it's the exact opposite proves your case.
Thanks for verifying my statement.
@Cliff-Mashburn saidYou didn't "cite" anything.
I don't think citing cases where it's the exact opposite proves your case.
That would require a link.
@AverageJoe1 saidAs my life progressed and I matured, I began to realize just why it was that people in the city
Then this is a vote on the Forum that the guy should be convicted.
So, never help anyone. Why,, you might get convicted
don't stop to help a person in distress. It's because they don't want to become a victim themselves.
@no1marauder saidThe other passengers, see it the way we see it. The guy stood up and handed his iPods to someone… That does not sound like someone who wants to murder the man. He thought he would just stop this for us. You read too much into things, man. You are telling us what the threshold is for being just too tough. I don’t think you can be too tough for a deranged maniac who said he was gonna kill somebody or whatever he said. The passengers were all behind our man penny. You were not there, just for the record. Note in the video how Penny was quite relaxed just had a hold on him until he settled down. Why don’t you venture a guess as to how many pounds per square inch were applied to this maniac.
Three guys restrained Neely with Penny jumping him from behind and holding him in a chokehold for 6 minutes.
That's the right wing version of "heroism" these days?

@AverageJoe1 saidI'll let the jury decide but according to testimony of one of the guys who helped him hold Neely down, Penny was told to relax the grip but refused. And neither of the charges require intent to kill nor did the prosecutor argue that Penny had such intent. Maybe you should actually read some versions of the testimony rather than just swallowing hook, line and sinker whatever you hear on right wing propaganda sources.

The chokehold "settled down" Neely to death according to the Medical Examiner.

Penal Law Section 125.15
Manslaughter in the second degree
A person is guilty of manslaughter in the second degree when:
1.He recklessly causes the death of another person;
AND
Penal Law Section 125.10
Criminally negligent homicide
A person is guilty of criminally negligent homicide when, with criminal negligence, he causes the death of another person. Criminally negligent homicide is a class E felony.
Neither being reckless or criminally negligent requires intent to kill:
3.“Recklessly.” A person acts recklessly with respect to a result or to a circumstance described by a statute defining an offense when he is aware of and consciously disregards a substantial and unjustifiable risk that such result will occur or that such circumstance exists. The risk must be of such nature and degree that disregard thereof constitutes a gross deviation from the standard of conduct that a reasonable person would observe in the situation. A person who creates such a risk but is unaware thereof solely by reason of voluntary intoxication also acts recklessly with respect thereto.
4.“Criminal negligence.” A person acts with criminal negligence with respect to a result or to a circumstance described by a statute defining an offense when he fails to perceive a substantial and unjustifiable risk that such result will occur or that such circumstance exists. The risk must be of such nature and degree that the failure to perceive it constitutes a gross deviation from the standard of care that a reasonable person would observe in the situation.

was this before or after toxicology and other test results were known?
was kneely still alive when removed from train?

I have no intention of litigating the case here for reasons I already gave i.e. the jury gets to hear far more evidence than internet posters.
@Mott-The-Hoople saidThe left is dividing the country? Yet here you are, making a hero of a white man killing a black man. I guess that's some unifying s--t right there.
the public is fortunate this drug abusing psychopath is gone…wonder how many of th 20 recent subway pushings he did.
Penney is a hero!
This case is more of the left dividing the country. All the qualifications were there, white against black
Idiot.
