Colorado Supreme Court bans Trump from Primary Ballot

Debates

Not legally relevant but interesting:

More than half of Americans approve of a Colorado Supreme Court ruling to bar former President Trump from the state’s primary ballot, citing the 14th Amendment, according to a YouGov poll released Wednesday.

The online survey, published just a day after the ruling, found that 54 percent of respondents either strongly or somewhat approve of the decision, with 35 percent disapproving.

Sure, they "accidentally" came to Washington, DC the day of the Electoral College certification.

Sure, they "accidentally" were told to "stop the Steal" or they "wouldn't have a country anymore".

Sure, they accidentally chanted "Hang Mike Pence" because he wouldn't go along with Trump's illegal plan to unseat State delegations to the EC and replace them with Trump s ...[text shortened]... ccidents"! Reminds me of this scene in Naked Gun: https://www.youtube.com/watch?v=LL67GmmREpY
No plan. Comprende'.

Do you think at the pre-insurrection briefing they discussed a 'Hang Pence" chant.

As so often happens it's your own words that trip you up.

And given that Biggs left the building on his way to the special room, that proves the accident. Which as it happens, it was you that researched that point for me, thanks.

But we see Ear Muff man, knit-cap man and Santa Claus man come from the direction of the special room, they came from behind police lines, then crossed police lines then turn around and put pressure back on the police line (who make a half hearted attempt to hold them back) and lead the crowd in the direction of the special room.

No plan, got it? It was a plan-less insurrection, but thanks for this post because you make my the case for me.

Yes a lot of people came to the Capitol that day, the plan was to peacefully protest but when the cops started throwing flash bangs into the crowd, and escalating the situation, spraying people with pepper spray when they had no way to retreat, just for, you know, the sake of torturing people some of the crowd in the heat of the moment fought back.

Here's the case of a woman beaten to death by her husband using a hockey stick. https://www.mirror.co.uk/news/uk-news/merciless-husband-who-beat-wife-27845132

In 2019, about 400 homicides in the US were done using "Blunt objects (clubs, hammers, etc.). https://ucr.fbi.gov/crime-in-the-u.s/2019/crime-in-the-u.s.-2019/tables/expanded-homicide-data-table-11.xls

The thr ...[text shortened]... ally mandated government function is plainly sufficient to meet the definition of an "insurrection".
you are making an ass of yourself.

In this country people have a right to protest the stealing of an election

When Trump is elected again all this will be exposed.

Here are the facts.

The democrats stole the 2020 election by abusing drop boxes, abusing mail in voting…allowing judges to usurp the power given to state legislators.

Now, they are abusing the system to interfere with the front runner republican candidate.

Smith got knocked down by the scotus with his attempt to keep Trump from campaigning by tying him up in court.

Smith being appointed special council by doj is unconstitutional. That power resides with the president and congress.

Our politicians are corrupt except for a few. Most belong to the establishment. They make it appear as a dem/republican thing when in fact it is an establishment thing.

That is why it has been allowed for judges to usurp power. It gets old hearing you libs say it was republicans that allowed so and so…no, it was the establishment that allowed it.

They have our citizens living paycheck to paycheck, credit card debt is out the roof, owning a home is out of the question.

Who do they help? The upper class.

Our border is non existent, people coming in to take your place.

And stupid ass liberals are too stupid to see it. Wear them dresses, lay up with your buddy, sex up the children.

All I can say is:

LMFAO!

Since this thread is about the legal implications of the Colorado case, I'll stick to them from now on. Debunking the ridiculous fairy tales that MB and Wajoma are pushing has been done in dozens of threads already; no rational court in the US is going to accept the type of claims they are making here.

Wise.

The courts say something. No'1 says: 'The courts said something', absolutely the safest route for you.

Those posts are off-topic just like yours; an attempt to change the subject.

As such, they are a waste of time to respond to.

One thing a court won't say is your fairy tale version of January 6, 2021 innocent protesters set upon by vicious, bloodthirsty cops and forced to reluctantly defend themselves you know by breaking into the Capitol and heading to where the Electoral College certification was to be done.

Repeat after me:

Section 3 of the 14th Amendment does not require a conviction, or even legal charges, of someone who engaged in an insurrection in order to disqualify them from any public office in the United States.

No CSA officials were charged with insurrection or rebellion but they were disqualified nonetheless.

Sometimes I think you dont understand how stupid you appear?

You are proving the civil war wasnt insurrection.
Did any of the confederate officers go on to become congressmen, college presidents etc?

Try reading Section 3 of the 14th Amendment. Here it is, one more time:

"Section 3 Disqualification from Holding Office

No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability."

The Civil War was a "rebellion" but the Framers of the 14th Amendment didn't intend it to cover only wide scale military resistance to the Constitution like what happened in 1861-1865.

Congress later adopted a wide ranging amnesty for CSA officials and others, so some did later hold public office.

Do these people that were polled have any qualifications, for lack of a better word (education, training experience, employment in the legal field, etc), to weigh in with their opinions on this matter? How was the array of those polled selected?? Sounds like a smart-ass question, but that is seemingly the only parlance you know.
