"Indeed, discovery in recent litigation confirmed that not one of
Pennsylvania’s 67 counties uses the date on the outer envelope to determine a

Registry of Electors (“SURE” ) system, 25 P.S. §1222 ensures that only timely
received mail and absentee ballots are counted. Department of State guidance

Pennsylvania Department of State, DOS Guidance at 2. Counties must also scan
the barcode on a mail ballot’s return envelope into the SURE system, creating an
electronic record of when the ballot was received. "

So the only thing the mandatory dating of an envelope serves is to provide another hoop for voters to jump through for no legitimate purpose. Such an interpretation of the law is clearly unconstitutional.

@Mott-The-Hoople saidShe's not a lawyer. Her comments were unfortunate, but no matter what sloppy reporting says, there was no clear command from the PA Supreme Count that those ballots couldn't be counted, just a stay of a prior order by an appellate court that they had to be counted. That arguably left the matter to the BOE's discretion.

IF the PA Supreme Court had been clearer in their November 1, 2024 Order, the whole mess (concerning a small number of ballots that broke almost evenly anyway https://www.cnn.com/politics/live-news/trump-transition-news-11-18-24#cm3nfgjb9000b3b6nj3a4r1mp) would have been avoided. Now the Courts will have to stop dodging the constitutional question and decide whether a failure by a voter to abide by this meaningless requirement is sufficient to deprive them of their right to vote.
@AverageJoe1 saidWhy Can He Not?
OK, so u are arguing before the court for BOE, they broke a law and are in jail. You and the Southern Legal Society are trying to have the law changed, moved, whatever.
Meanwhile, they have no rights to get out of jail. Why? Tell us why they are in jail. Even the jailer thinks the law is not fair. He wants to let them out. Why can he not.?
Can you believe Sue keeps bringing up the PO which has absolutely NOTHING to do with a voter filling in a date? What if voter puts it in a drop box, or doesn’t for that matter.
There is one issue a law is ignored, they count anyway. I will not invite the to THiving dinner! Lawbreakers. They admitted it.
@AverageJoe1 saidIn PA, drop boxes are only accessible until 8 PM on election night. https://www.pa.gov/en/agencies/vote/voter-support/mail-in-and-absentee-ballot/return-ballot.html#accordion-de4d034c00-item-16582f4448

"At 8:00 p.m. on election night, all Ballot Return Sites and drop-boxes must be closed
and locked. Staff must ensure that no ballots are returned to Ballot Return Site after the
close of polls.
After the final retrieval after the closing of that ballot collection site, the drop-box must be
removed or locked and/or covered to prevent any further ballots from being deposited,
and a sign shall be posted indicating that polling is closed for the election."

I did say something like drop them or mail them. You see, it may or may Not have some date from a PO or from a letter-carrier or anyone………The problem is anout the required date that a voter must put on it.
You are so overboard to get into the weeds on the previous posts about extraneous information. Really strange.
@AverageJoe1 saidDo you think that voters who forget to put a date on their mail in or absentee ballot should go to jail for "breaking the law"?

@AverageJoe1 said75 million are NOT looking to end democracy and pronounce Trump KING Trump.
Jesus, kiddies. 75M are looking for change. It could not be worse, could it. Can any of you be a bit hopeful?
See adjacent post, PA vote counters are actually breaking law to count invalid ballots.
They want the economy to do better, and Trump WILL fuuk that up since he is the most incompetent IDIOT ever to take the reigns of office, MUCH worse than even Harding.
Putting in the absolute worse POS people in high office when we have so many threats to our country is fuuking INSANE.
So the US will be run by a psychopath with people whose only bullet on their resume is 100% total loyalty to Trump and Trump alone, FUUK the constitution which they want to get rid of anyway.
Who needs that devils work we call a democracy anyway?
@no1marauder saidNo, of course not. This thread is not about those people ‘going to jail’. You know, sue et al put a lot of stock into your posts, …just sayin’.
Do you think that voters who forget to put a date on their mail in or absentee ballot should go to jail for "breaking the law"?
This requirement; whether it is a law or not, simply says that an undated ballot cannot be counted. That is it.
We all know that you have umpteen reasons that is a stupid requirement. Let’s say that I think it’s stupid too. I believe in rules and regs, which say to not count these incomplete ballots. So, though I think that this law and jaywalking laws are stupid, I believe in supporting the laws as written,
You, do not.
Speak to the issue please.?!!??
PS, This question is not asking ‘what you think’. It is asking should we follow the law.

We have Republic and democratic features.

@AverageJoe1 saidThe law doesn't say that as I've pointed out numerous times. It's silent on what happens to the ballot IF the outer envelope containing it has no date or an obviously incorrect one (it seems people sometimes erroneously put their birthdays on it). A trial court and an appellate court (called the Commonwealth Court in PA) said not to count the ballots under such circumstances was in violation of the PA and US Constitution and ordered the ballots to be counted. The PA Supreme Court right before the election stayed that order, but did not specifically say the county couldn't count the votes. AFTER the election, the PA Supreme Count said the ballots shouldn't be counted because the other courts' orders were too close to the election, but didn't rule on the constitutional issue.

That's what happened; you and Mott constantly saying the BOEs "broke the law" is inaccurate.

You apparently don’t know the difference . Ask marauder for a treatise on it. I am just the messenger
@AverageJoe1
So you will be TOTALLY happy when it is King Trump and he doesn't even have to proclaim it, it just sneaks up on us. Of COURSE you personally will come out just fine because Trump will know you are a permanent ass kisser.
And that will be AFTER Trump has ruined our thriving economy blaming it on internal traitors, Trump will NEVER take responsibility for ANY of that just like he never took responsibility for his incompetence in 2017.
