Here's my prediction:

There's a decent chance the SCOTUS doesn't even hear the case if and when the lower courts toss Trump's EO out. If they do, the most votes the overriding of this venerable precedent will muster is 3 and probably not even that; while Alioto seems willing to do anything Trump desires, both Thomas and Gorsuch pay some lip service to the wording of the Constitution and in this case that wording is unambiguous.

No, there is no provision in the Constitution allowing Congress to "clarify" i.e. change the meaning of the 14th Amendment.

The SCOTUS "clarified" it regarding this issue 126 years ago.

An unconstitutional law is no different from an unconstitutional EO.

You do realize that there are still abortions in the US, don't you?

I've made my prediction; if I thought you were trustworthy (I don't) I'd place a wager on this case's results in the Federal courts including, if it happens, the SCOTUS.


Apparently the EO doesn't apply to anyone at this time:

"Sec. 2. Policy. (a) It is the policy of the United States that no department or agency of the United States government shall issue documents recognizing United States citizenship, or accept documents issued by State, local, or other governments or authorities purporting to recognize United States citizenship, to persons: (1) when that person’s mother was unlawfully present in the United States and the person’s father was not a United States citizen or lawful permanent resident at the time of said person’s birth, or (2) when that person’s mother’s presence in the United States was lawful but temporary, and the person’s father was not a United States citizen or lawful permanent resident at the time of said person’s birth.

(b) Subsection (a) of this section shall apply only to persons who are born within the United States after 30 days from the date of this order.

So it's not even retroactive and only applies to persons born after February 19, 2025.

It's still unconstitutional but it doesn't even do what drones like Mott want i.e. revoke citizenship for millions of Americans.
