The present thread is about the US opposing ICC (International Criminal Court). This thread is not directly devoted to Russia or the Russian invasion of Ukraine.
Moreover, the question of invading another country concerns the issues of justified/unjustified war. Unjustified war is a crime against peace. Crimes against peace are not war crimes. Crimes against peace are not well regulated by international law. The ICC does not handle crimes against peace, it handles war crimes.
Therefore, your "basic question" is indeed an irrelevant question in the present thread.
Moreover, you are absolutely wrong in saying that I have NEVER answered that question. I have presented my views about whether this war is justified or not. But I have done it elsewhere, not in the present thread.

I would argue that the US is guilty of giving very little thought about the possible deaths of civilians when carrying out a campaign whilst I believe it will be proven that in Ukraine, just as in Grozny and Aleppo civilian deaths are central to Russian strategy.
