the correct argument is that nobody aborts a 6th month fetus in the first place. That's just called birth.

Terminating the fetus should be a decision between the doctor and the woman. Terminations in such a late stage often imply the woman is in iminent danger, going to a court or having the doctor fear jail or license loss is downright criminal.
