The guy who said “let’s step outside” could always argue he meant that you and he should continue the argument outside so as not to bother other bar patrons.
But even if he said “Let’s fight,” I still say it depends on who threw the first punch.
And if you continued beating on him after he no longer posed a threat to you, I’d say you’re definitely in the wrong.

Just something I'm curious about in terms of legal liability with a willingness of both parties to step outside.

-Removed-That would be up to a jury to decide. In the States depending on the State quite possible. Even here in Canada the law varies from Province to Province. What is right and wrong and the law, don't always agree with each other. If someone asking me to step outside back in the day, it is going to happen right there. The talking has already stopped.
