Suppose that you're in a bar, and you get into a verbal dispute with someone, and he says "let's step outside ".

You agree, and both of you step outside, and you then proceed to whoop his ass.

Are all legal liabilities void since it was a mutual agreement to "step outside"?

Probably depends on what state you’re in. In Texas, I can imagine you could blow his brains out in the parking lot and still be acquitted.

Just something I'm curious about in terms of legal liability with a willingness of both parties to step outside.

I think it depends on who threw the first punch.

The guy who said “let’s step outside” could always argue he meant that you and he should continue the argument outside so as not to bother other bar patrons.

But even if he said “Let’s fight,” I still say it depends on who threw the first punch.

And if you continued beating on him after he no longer posed a threat to you, I’d say you’re definitely in the wrong.

I'd say at that point if the person steps outside then you are equally responsible for what ever happens after that. πŸ™‚

Impossible question to answer as it’ll be different wherever you are.

That would be up to a jury to decide. In the States depending on the State quite possible. Even here in Canada the law varies from Province to Province. What is right and wrong and the law, don't always agree with each other. If someone asking me to step outside back in the day, it is going to happen right there. The talking has already stopped.

I am not an idiot as popular opinion would like to think. What do you think the guy is looking for if he is asking you outside? Does he have some back up our there or someone with a weapon. May as well finish right inside the Pub/Tavern, lots of witnesses, just make sure he takes the first swing after that all your doing is defending yourself. Got nothing to do with being a bad dude or a good dude.
