No, rape is sex without any consent. In England the age of consent is 16, and there is a seperate offence of sex with a minor - on the grounds that they are deemed unable to give consent. In the cases where there is no consent the rapist is charged with rape, and when there is consent, just not legally valid consent, the adult is charged with sex with a minor. Do you really intend that in the case of a 17 year old boy who slept with his 15 year old girlfriend the authorities should intervene and charge him with rape?

Because of some of the discussion earlier I just wanted to point out that the child hasn't commited a crime, whether they were a willing or unwilling participant - the person they had sex with is assumed to be over the age of consent.

To my mind the question is one of consent. If someone has gone through puberty then they are going to have a sex drive and so on and are capable of making their own mind up. Although it's unlikely, you could have a 16 year old who hasn't reached puberty but, as things stand, it is legal for someone to have sex with them.

what are you talking about?
We're talking about an 11 year old, not a 15 year old.

An 11 year old cannot consent to sex with a 30 year old, the law protects the child from such perversion.

Well, if the juvenile has gone through puberty then it is possible for them to want sex, and I don't see a reason to stop it provided it's consenual and suitable precautions are taken against pregnancy, disease and so on. If they haven't gone through puberty then it's going to be a rape anyway, so you don't need an "age of consent" law to protect that case. The law was introduced as a way of controlling child prostitution, so that the authorities had something to charge the clients with; but laws exist to deal with this angle as well.

I have just read through the thread and i apologise for not giving any details of the girls pregnancy,i just thought that a pregnant nine year old girl is just that,how she fell pregnant shouldn't matter.
For the record here is what i know:
The girl was a nine year old who is part of the Apurina tribe in Brazils Amazon rainforest,i do not know any details of the father .
I also apologise for the original post as my wording seems to be wrong according to some responses.What i should of posted was ----

It is wrong for a nine year old to give birth.
We do understand that she came from a very poor South American tribe and no details were given on the father. I read today the poor girl had to have a C-section. Probably would have died trying to give birth naturally.
From paleo biologists studies, they have concluded child bearing age of cro magnon and neanderthal humans to be around nine, as their life expectancy was only 18-20 years.
Are we regressing as a species?
