I think what you are referring to is his release from U.S. Military custody. They have been holding him since his capture for security reasons. Can't get inside help to assist him in escaping, no angry relatives of victims can kill him etc. etc.
They released him into Iraqi custody already.

I am talking about the punishment at hand for Saddam. (BTW he had many years in power as well). What punishment would you think is fair?

Secondly I would say there is no meaningful way of balancing crime and punishment.
A person who has the ability and intention to commit mass murder through their own justified intention will do this.
How do you adjust the punishment from someone who has murdered one person to someone who has murdered ten people.
The socialogical model does not work, it cannot compensate for the weakness of our nature.
