Let's say, for the sake of argument, that the speech alone creates a "close case" as to whether Trump knowingly incited the crowd to insurrection. If that was all the evidence, perhaps an overruling of the State's court decision would be justified.

But there is far more than that both before, during and after the insurrection. For the before and after, I'd refer you to ...[text shortened]... asn't quite pleased his supporters attacked the Capitol with the intent of overturning the EC count?

So, after all this bellyaching, you finally come forward and say yeah, maybe there’s another side of what went on that day and maybe he’s not so guilty. So you are hedging, so that when SCOTUS shuts it down, u can say you knew they might’? Jesus…..and duh.

Secondly, “Trump refused for hours to tell the insurrectionists(??) to leave the Capitol”?? Did he have a duty to do that? You and your crappy CO judges kicked his ass for what he did NOT do?!?!?? Would that be an issue for the court,, what he did NOT do???? Holy Smokes, Marauder. I am going to turn on my NexLex for that one. Must have missed that class.

I am going to reread your post, be sure I got it right.
It was his job to "preserve, protect and defend the Constitution of the United States" according to the oath he took. The fact that he refused to do so by telling the mob he had assembled to disperse for hours and stop violently interfering with the the counting and certification of the Electoral College mandated by the Constitution is surely evidence of his intent.

Yes, yes, and yes, what you do NOT do can constitute severe dereliction of duty. If you do not feed your infant and it dies, you are guilty of criminal neglect. Trump clearly revelled in the riot he caused and hoped it would lead to Biden's victory being set aside; that's why he waited so long to call off the wolves he'd set loose. Even McConnell said Trumps' behavior on January 6th was despicable, but McConnell hadn't the balls to impeach him.

Trump's one throwaway line hardly comports with reality; the fact he was still pretending they were "peaceful" well after they had violently broke into the Capitol and later praised the mob's actions (see his 6:01 tweet) show his attitude towards the violence.

Both of those tweets were AFTER the mob had already broken into the Capitol by violently attacking police and smashing windows and breaking down doors, something Trump had watched on TV.

He was lying as usual, pretending they were being peaceful.

IF Trump really wanted his mob to be peaceful, how come he didn't send something like this after he saw them violently attacking police and smashing windows and breaking down doors to get into the Capitol?:
