I disagree with you that a person will say anything under the influence of alcohol. You are certainly aware that alcohol disables inhibitions and filters.

That is, if he were no traspassing the limits that the law impose to the "free speech" right (a patent oxymoron here). (I mean that if his declarations were libelous, he could be demanded for that... but only by the attacked person/s).
He should be punished by driving being drunk. That's all.
BTW. I think that "free speech" is only a convenience for the goverments to make us feel secure to emit our opinions without being punished. But as soon as they see something "inconvenient" in you doing that, you will be inmediatly censored.

Peer pressure makes him apologize. I am speculating, but what he said drunk was probobly what he thinks sober. Have you ever know anyone who gets so drunk that they say what they don't think? Not me, not even once. People often say things drunk that they would not say when they are sober. As Nemesio pointed out, alcohol has a tendency to break down our inhibitions.
Now, when he’s sober and reasonable, Mel may well repress some his anti-Jewish sentiments. He may find them despicable himself—which is why he might try to hide them even from himself, not admit them even to himself. After all, the first step in getting an alcoholic on the road to sobriety is getting him (or her) to admit to himself that he’s an alcoholic: it’s called “first step.” Mel may be well advised to do a first-step with regard to the anti-Jewish stuff as well as his alcoholism (ought to include it in fifth step as well).
Re The Passion: am aware of the controversy that was going on, but I did not see it so can’t comment on it at all.
