He was obviously trespassing and his and others trespassing clearly obstructed the Electoral College count. Moreover, he not only entered the Senate chamber but sat in Pence's place, initially refused requests/orders to leave and then left a threatening note to VP Pence, who he admitted to calling a "f***ing traitor" in his plea agreement.
