Because the Biden team didn’t lie about what documents were found and informed the records office as soon as they found them, wherever they were found.
Trump and his legal team told a litany of lies about which documents trump held at mar a largo.
Biden has messed up with these documents there’s no doubt about that but let’s see the investigation find malicious intent on his behalf before you drag your gallows back to the capitol

Nonetheless, that fact was irrelevant to the DOJ's 2023 investigation into documents discovered at a former office and home of Biden. Merely declaring a document declassified, or thinking that it is, does not make it so; federal law governing government documents
requires presidents to follow certain steps to officially turn a classified file into a declassified one, which include physically modifying its markings. None of the documents found Mara Lago or Biden's office and residence had those modifications.

While both the Biden and Trump cases appear to involve improperly retained classified information, the number of documents involved for each appears to differ substantially. Further, the Trump documents were found at a location that doubles as a pay-to-play club and event hosting space. Finally, the Biden documents were immediately returned to NARA, and did not require an FBI raid to be recovered.

It's "intent" to hold the papers. Trump has clearly claimed the documents were his and did not need to be turned over to the Federal Archives. Trump intended to take and keep classified documents. Yes, Biden screwed up but there is no evidence of intent on Biden's part to take and/or keep classified documents. "Intent" is one of the differences between first, second and third degree murder. It is an important legal term.
