The Australian legal system is essentially the same as yours and the issue of whether immigration detention is imprisonment (ie jail) has gone to the highest court in the country. It's been made abundantly clear that illegal immigrants are not criminals, and cannot be imprisoned. Immigration detention is an administrative process performed by the Executive arm of government. Criminal conviction is a judicial process, performed by the courts.

This is the basic legal point you don't understand. Illegal and criminal are NOT the same thing. Ironically, it's you that don't know the meaning of ILLEGAL.
A person who enters a country unlawfully/illegally is liable to be deported, yes. They may be administratively detained to facilitate that deportation, yes. But this does not mean - and never has m ts were charged with a crime, it would be contempt of court to deport them in the meantime.
Crime: an action or an instance of negligence that is deeemed injurious to the PUBLIC welfare or morals or to the interest of the state (United States) and that is LEGALLY prohibited (like crossing our border).
