The bureaucrats in Australia COULD have been smart and seen to it that there was a systematic admnistrative review on a regular basis, but they didn't - at least not properly. It was left to their discretion.
In New Zealand, Canada and South Africa this simply can't happen. The law sets out exactly how long someone can be detained before their case comes back before a court or tribunal or board or whatever, to check whether the detention should continue. If that doesn't happen, the detention is no longer lawful. The authorities have to actively DO something on a regular basis.
[Actually I think in South Africa there's an absolute limit on detention as well. Can't remember off the top of my head for NZ.]
The fundamental difference is that detention here in Australia is mandatory. So (until now) the law has acted like there is nothing to decide or review. We now of course realise there ARE things that need review, like 'does this person actually meet the criteria for being an illegal immigrant'. This was the problem with Cornelia Rau - no-one figured out that she WASN'T an illegal, because once they'd made up their mind the first time there was no obligation to re-check.

Ragnorak fails to see that the reason those undesirable jobs are so undesirable is because the cheap illegal labor force drove those wages down to that postition.

For starters, how do you think you determine whether or not a person is an 'illegal fugitive'?
My advice to you is don't travel. Anywhere. Because if you DO, then some official or policeman somewhere might just decide they don't like you, rip up your passport, and throw you in a cell somewhere. And when you complain, they'll say "you're here illegally, the due process of law doesn't apply to you".
