Both

It is much better with both knowing that one has no holding on the other. If one feels like moving on, it should be as easy as possible.

I am not sure why courts need to be tied up and why lawyers need to benefit from splits.

Unless a prenup is done. If the couple don't stay together then there is a fight that could go on for years by the lawyers depending on how rich they both happen to be. Many will have a prenup drawn up, many do not and those are the ones who have the biggest problems. It is the children if there are any that really get hurt in all of this.

i am not going to tell you anything you do not know
marriage is a contract
perhaps now i will tell you something for yer edification
the courts are involved because property, both real and virtual, children, healthcare and related decisions, and even social standing is affected by the separation of interests

lawyers do not need to be involved unless there are legal complications and considerations
