Well, I don't know... First I thought the same, but if he's 19, that sounds more serious. At that age I think most siblings have got over sibling rivalry and silly fighting. And threatening to stab his brother sounds really out of line. Not knowing him, it's impossible for me to figure out whether there's a real danger or not, but in any case I think it goes beyond "that's what brothers are for". But I also agree that a legal solution should be the last resort. Maybe you (meaning bad wolf) could talk to a counsellor - together with your brother, if he's willing to do so.

He has made several threats, threats of violence, there has actually been fights between us, he has on several occasions threatened to stab me as well.
This is normal behaviour between siblings.

The problem is then that we do co-habit, we live together, we live in the same room even; changing this would be quite difficult.

I think it is very much a territorial thing, it is actual the biggest bedroom in the house, and if we didn't share it one of us would have to move into the smallest room. This would be fine with me I guess, but only if some of this stuff, the tumble dryer, etc, were moved into other big room, and he won't have it.

It would also be a very big financial burden on him to leave as well, he doesn't have a very well paid job, so that is perhaps why my parents are reluctant to make him leave.



What is a civil injunction?
Is it expensive, you mentioned financial assistance?

3. I'd get hurt.

If I pursued legal action, luckily my family would back me, not him, I am certain of this.

Ah, that explains a lot. I was fighting with my sister all the time until we got each our own room (when my older siblings moved out). You say it would be quite difficult to change this situation, but if it's just "he won't have it", this doesn't sound unsolvable. If you can convince your parents that this is necessary to make the family function, they can give him a choice - either let you move into the small bedroom and have some stuff moved to his room, or find his own place to live.

I discussed this with them earlier today, it's going to be a lot of fuss to sort out if we did it.

One problem noted was that the tumble dryer needs like a pipe at the back to go outside, a new one would be needed to be installed in the other room when it were moved.

Those threats feel a lot more real than you consider what he has: he already has a few pen knives and disturbingly enough a 3 inch dagger, he also has Knuckle duster, which he has already used against someone he had fight with.

Wtf am I supposed to think he is capable of?! 😞

I really do not see how a civil injunction could work. It is usually available in tort law and while what your brother is doing to you may amount to tortious liability an injunction is usually only a remedy for private nuisance, trespass to land, and defamation. The only injunction that I could honestly see working and it would be a very long shot would be a prohibitory injunction which is an order of the court to prevent recurrence of the tort, that being assault. If your brother was to breach this it would be a very severe matter, but I must stress that a civil injunction is the wrong route to take, a restraining order is by far the best possible remedy.

Whoa. You both live at home with your parents?!? Simple solution, move out. Or take the small room. Nordlys was right, that crap should stop by the time you get to be adults... but if you're both still clinging to the homestead neither of you are grown up.

Seriously. do you have a job? How old are you? If you are eighteen or older, you should have two things - a job, and your own place to sleep.
