    A white teen who sodomized a mentality handicapped black student with a coat hanger, will face no jail time:

    A former Idaho high school football player originally charged with sexually assaulting his mentally disabled teammate will avoid jail time and escape classification as a sex offender after pleading guilty to a lesser felony.

    John R.K. Howard, 19, of Keller, Tex., pleaded guilty to a felony count of injury to a child and will be sentenced to two to three years of probation and up to 300 hours of community service, the Idaho Statesmen reported. A judge will decide the final sentence on Feb. 24.

    Deputy Attorney General Casey Hemmer said if the case had gone to trial, prosecutors would have been able to prove Howard kicked a coat hanger into his teammate’s rectum during the October 2015 attack — but a modified guilty plea submitted by the teen allows him to maintain his innocence while still acknowledging he would have otherwise been convicted.

    “It was egregious behavior, it caused this victim a lot of suffering, but it is not in my view a sex crime, which is why the state has amended this charge,” Hemmer told the Statesmen. “We don’t believe it’s appropriate for Mr. Howard to suffer the consequences of a sex offender, but he still needs to be held accountable.”

    The plea agreement was met with “bitter disappointment and outrage” from the boy’s family, their attorney R. Keith Roark said.

    The victim “was taunted and called racist names by other members of the team which names included ‘Kool-Aid,’ ‘chicken eater,' ‘watermelon’” and the n-word, the Washington Post reported.

    If it was a black (or any other race) kid doing this to a white victim, there's no way in hell the perpetrator would walk. No one, regardless of race, should ever get away with this; yet, when the victim is black and the aggressor is white, that's exactly what happened.

    You are crazy. A similar thing happened around here with a broom stick which involved all white kids. It is hazing. It is rarely punished with jail time.

    A) Hazing involves willing participants; the victim in the OP was forced to endure the assault against his will

    B) Who willingly agrees to have a coathanger shoved in their rectum, then have it kicked in further while racial slurs are being yelled at them?

    C) According to what I read about the hazing case you posted, there was no conviction because it couldn't be proven that harm was intended or even expected. The teens in the OP clearly intended harm, and had to know that kicking a coathanger into someone's rectum causes harm.

    If the victim was white and the perpetrators were white, I'm 100 percent sure you wouldn't be offering a defense of their actions.

    What if the perpetrator was a star athlete, who was idolized by his community?

    I know of a case where an American public school's white administrators apparently did
    their utmost to protect a black star athlete who was accused of raping a white cheerleader.

    How do you know that race has anything to do with this case? If the prosecutor thought it was egregious he did not have to offer a plea deal and if the judge thought it was egregious he could have given jail time. It seems far more likely that the case simply wasn't as strong as claimed and/ or the judge responded to continual criticism that the United States puts too many people in jail.

    What if the perpetrator was a star athlete, who was idolized by his community?

    I know of a case where an American public school's white administrators apparently did
    their utmost to protect a black star athlete who was accused of raping a white cheerleader.
    The underlying point, of course, is that our admonished plea to keep justice blind is often thwarted by the subjectivity of our hearts.

    Lesson: don't trust your heart.

    Racism may be relevant as a motivation for the crime.
    But did racism influence the district attorney in negotiating a plea agreement?

    This seems similar to the Brock Turner case: a case of white male favoritism. In both cases, a young white male student athlete recieved little to no punishment for sexual assault, with the belief that it would be too extreme to punish these young men to harsher sentences.

    It is quite possible, however, that racism may have influenced the non-sentencing of Howard.
